| 华容县县委、县政府关于鼓励投资的若干规定 |

为进一步优化投资环境，降低投资成本，提高投资效益，吸引国内外客商来我县投资兴业，依据国家有关法律法规和政策，结合我县实际，作出如下规定。
一、范围和对象
1、本规定所指投资，包括以资金、技术、设备、项目、品牌和其他可投资权益（含知识产权）等进行独资 、合资、合作、联营、租赁、购买、兼并等行为。
2、凡来我县投资法律法规许可范围内项目的国外及港 、澳、台地区和国内企业、其他经济组织、社会团体、事业单位和个人（以下简称投资者），除依法享受国家和省市有关优惠政策外，同时适用本规定。
3、属国内外知名企业、省以上专门机构认定的高新技术产业项目、名优品牌及固定资产投资额在3000万元人民币（下同）以上的项目，可以通过“一企一策”、“专项专议”、“特事特办”，另行确定优惠办法。
二、财政支持
4、投资者新办符合国家产业政策和我县产业发展规划的生产性项目，从项目合同约定的投产年度起5年内，前2年按所缴企业所得税直接构成县级财力部分100%、后3年按50%的比例由县财政奖给企业扩大再生产或进行技改。固定资产投资额在500万元以上的新上或新增投资且年上缴县本级税收50万元以上项目的，落户我县工业园区或属高新技术产业、纺织业、节能环保型项目的，在依法足额缴纳税收的前提下，从项目合同约定的投产年度起5年内，前2年按企业当年所缴增值税直接构成县级财力部分100%、后3年按50%的比例由县财政奖给企业扩大再生产或进行技改。
5、投资者利用荒山、荒水、荒洲、荒坡、荒地兴办农业科技开发项目，固定资产投资额在200万元以上或注册资金在500万元以上的农业资源综合利用项目，从投产年度起3年内每年按上缴税收构成的县级财力部分50%的比例由县财政奖给企业扩大再生产。
6、投资新办非公益类医疗卫生、职业教育、旅游开发和生产性服务业等三产业项目（不含房地产开发及建筑业、宾馆、餐饮娱乐业、零售业。其中旧城改造、经济适用住房建设、廉租房建设等项目按相关优惠政策执行。下同），且注册资金在300万元以上的，从开业之日起5年内，按已缴纳税收构成县级财力部分50%的比例由县财政奖给企业。
7、企业与大专院校、科研院所开展产、学、研合作，其技术成果转让、技术培训、技术咨询、技术服务、技术承包所取得的技术服务收入所缴企业所得税中构成县级财力部分由县财政全额奖给企业。
8、凡获得“中国驰名商标”和“中国名牌产品”的、通过国家地理标志产品认证的，由县财政奖励10万元；获得“湖南著名商标”和“湖南名牌产品”的，由县财政奖励5万元；获得省级以上各项博览会金奖和名优产品的，由县财政给予适当奖励。
9、凡我县投资项目运作资本市场独立上市成功的，由县财政奖励100万元；捆绑上市的企业融资部分在我县投资比例达50%以上的，由县财政奖励50万元。
三、土地使用
10、投资者来我县投资农业综合开发项目，在不改变用地权属和用地性质的前提下，其用地可采取租赁、作价入股等方式供应。
11、对我县工业园区建设用地，可一次规划、分期征收、分期开发；允许农村集体利用土地征收补偿费用和其他拥有出让土地权的单位、个人以土地使用权作价入股或联营兴办各类企业。
12、 投资者在我县工业园区兴办资源开发型、农副产品加工型、高新技术型和出口创汇型等工业项目需取得土地使用权的优先提供用地指标，其所需用地由县政府依法征收后按有关规定供地，土地总价款实行收支两条线。
13、投资项目增资扩产需新增项目用地的，可施行规划控制。
四、规费收取
14、所有投资项目规费收取按《华容县投资项目规费收取标准》（附后）执行。其中行政性收费（基金）由投资者或代办单位持县政府审批文件，到县行政服务中心缴费。收费使用省财政厅统一印制的收费票据，收取的资金按规定及时足额缴入财政非税收入汇缴结算帐户。服务性收费除法律法规规定必须服务的外，其它服务项目由投资者根据需要自行选择；服务和被服务双方根据服务范围、工作量依法签订服务合同，具体收费优惠标准见附件。
15、对固定资产投资额在500万元以上的规模工业企业规费收取实行 “一事一议”。项目建设期间除税收外，免收县本级行政性收费，服务性收费按照投资项目建筑工程造价的5%包干收取。申请规费优惠的投资企业须向县招商局提出书面报告并附相关单位的确认资料，由县招商局呈报县政府审批。
16、为鼓励投资企业按规定登记注册和增资扩产，由县财政安排专项经费给予县本级投资企业注册登记费用补贴。凡固定资产投资额在500万元以上的工业项目按费用总额的50%、农业项目按费用总额的30%、非公益类医疗卫生、职业教育、旅游和生产性服务业等三产业项目按费用总额的20%予以补贴。补贴专项经费经县财政局审核并报县政府同意后，拨付县行政服务中心专款专用，由县行政服务中心核准后拨付使用。
五、优质服务及权益保护
17、简化投资项目审批程序。县发展和改革局为县政府投资主管部门，负责投资项目的核准和备案管理。投资者不使用政府性资金建设的项目，按照《湖南省政府核准的企业投资项目目录》（以下简称《目录》）的规定，区分不同情况实行核准制和备案制。对投资者不使用政府性资金建设《目录》中的重大类、限制类企业和外商（含港、澳、台、侨胞，下同）投资项目实行核准制，属县政府投资主管部门核准的投资项目，不再审批项目建议书、可行性研究报告和开工报告，投资者只需编制项目申请报告书报送项目核准机关核准即可。属县政府投资主管部门以上核准的投资项目，由县政府投资主管部门提供全程协办服务。对投资者投资《目录》以外的项目只进行登记，实行备案管理。
18、投资者办理项目申报、登记、征地、报建等手续，所涉县内有关手续由县行政服务中心各办事窗口在投资方资料齐全的前提下七个工作日内办结。凡需报市级以上审批的，由相关县直单位全程领办，在规定期限内办好有关手续。
19、县政府负责组织落实项目用地范围内的拆迁安置及厂区外围的水、电、路、电视、通讯“五通”工程。“五通”工程费用按“谁受益、谁出资”的原则由相关单位承担。对于有特殊要求的投资企业，按相关规定办理。
20、投资项目的考察、洽谈、签约由联系引进单位和县招商局负责；项目建设过程中行政审批、核准、登记等行政许可事项（必须由项目法人自己办理的事项除外）由项目落户地所在单位负责提供全程代办，县招商局协助；项目开业营运后的协调服务工作由县招商引资领导小组指定牵头领导和责任单位负责。
21、投资者在县内兴办固定资产投资额在500万元以上的劳动密集型工业项目，由县劳动和社会保障局、县工业局协助做好所需劳动用工招工工作。
22、严格规范执法行为。对投资企业的行政执法检查，必须先到县优化办备案，特殊情况下事后必须及时向县优化办报告。除环保、安监、公安、计生检查外，其他检查须在每月的企业检查接待日内进行，不准重复检查和交叉检查，并实行“首查警示免罚制”，即首次检查发现一般违规问题，只帮助整改，不作行政处罚。
23、对固定资产投资额在1000万元以下的重点企业，由县委、县政府派驻优化环境特派员，并按属地原则实行公安派出所长挂牌服务制；固定资产投资额超过1000万元的，可以设立公安值勤室，为企业提供跟踪协调服务。
24、外来投资者享受本县居民的同等待遇，子女就学优先安排不加收任何费用。
25、固定资产投资额在500万元以上的企业，对企业法人的活动和交通运输车辆，在无违法违规的前提下，县境内一律免查；轻微违规，只纠错不予处罚。
六、附 则
26、鼓励县内外、境内外个人、团体及中介组织为我县招商引资牵线搭桥，奖励办法按《华容县促进经济发展的财政奖励暂行办法》执行。
27、本规定自下发之日起施行，华发〔2007〕1号文件同时废止。本规定由县招商局负责解释。

二、Financial support
